Area of application

These General Terms and Conditions in the version valid at the time of conclusion of the respective contract shall always apply to all mutual claims arising from and in connection with the conclusion of a contract between the customer and Strumpf Dirks GmbH.

The aforementioned contract between Strumpf Dirks GmbH and the customer can be concluded both via the mail order business and online via the Internet business.

Contractual partner

Strumpf Dirks GmbH concludes contracts with business customers who are natural persons with unlimited legal capacity who have reached the age of 18.

Customers who violate the business policy of Strumpf Dirks GmbH may be excluded from the further purchase of goods.

Contract contents

Strumpf Dirks GmbH delivers the goods ordered by the customer as part of the acceptance of the offer.

In the event of withdrawal/cancellation, Strumpf Dirks GmbH shall be obliged to immediately credit any advance payments and/or prepayments made or, if requested, to refund them by cheque or bank transfer.

Conclusion of contract

The customer submits a binding purchase offer for the goods selected by him in the Internet transaction when he has gone through the online ordering process by entering the information requested there and clicks on the ‘Send order’ button in the last order step.

Acceptance by Strumpf Dirks GmbH in the case of Internet transactions shall take place upon receipt of the goods by the customer after the goods have been sent by Strumpf Dirks GmbH.

If the customer orders via the Internet, Strumpf Dirks GmbH shall immediately confirm receipt of the order electronically. However, an order confirmation does not yet constitute acceptance of the contract.

Data protection Customer data

By completing an order, the customer agrees that his/her data may be passed on to DHL and/or DPD for dispatch.

Payments by invoice for first-time customers (new customers):

Strumpf Dirks GmbH reserves the right to exclude payment by invoice for first-time customers (new customers) following a check. In this case, Strumpf Dirks GmbH shall only offer payment in advance.

The goods remain the property of Strumpf Dirks GmbH until payment has been made in full.

Liability

Strumpf Dirks GmbH shall only be liable in all cases of positive breach of contract, default, impossibility, unauthorised action and for other legal reasons (with the exception of pre-contractual breaches) in the event of intent and gross negligence.

The scope of Strumpf Dirks GmbH's liability under the Product Liability Act remains unaffected.

Other

German law shall apply to the legal relationship between Strumpf Dirks GmbH and the customer as well as to the respective terms and conditions. The application of the UN Convention on Contracts for the International Sale of Goods of 11 April 1988 is excluded.

The customer has no right to purchase specific goods or quantities of goods. There is also no right of set-off or retention unless the claim is undisputed or has been legally established by a court.

Should individual provisions of this contract be wholly or partially invalid or lose their legal validity at a later date, this shall not affect the validity of the remainder of the contract.

Place of jurisdiction

The exclusive place of jurisdiction is Coesfeld or another legal place of jurisdiction at the discretion of Strumpf Dirks GmbH, insofar as the customer is a merchant within the meaning of the German Commercial Code or a public corporation.

In all other respects, the place of jurisdiction prescribed by law for the consumer in his home country shall always apply.
